Terms of Use

These Terms of Use (“Terms”) govern your access to and use of HyHut websites, APIs, game hub integrations, and hosted Hytale servers (together, the “Service”). By creating an account, linking a Hytale account, creating a server, or purchasing a plan, you agree to these Terms. If you do not agree, do not use the Service.

HyHut is a hosting platform for Hytale worlds. Hytale and related marks belong to their respective owners. HyHut is not affiliated with or endorsed by Hypixel Studios unless explicitly stated.

1. Eligibility

You must be able to form a binding contract in your jurisdiction and comply with applicable laws, including any age requirements for Hytale and online services. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

2. Accounts and Hytale linking

• You must provide accurate registration information and keep your email address reachable.
• Linking a Hytale account associates that identity with your HyHut account for ownership and in-game management.
• You may not impersonate others, evade bans, or share accounts in a way that undermines security or billing.

3. Hosted servers

• Free-tier servers are subject to resource limits and idle sleep. You may create multiple servers, but only one free server may be online at a time per account. Upgrading a server to a paid plan frees that slot so another free server can be started. When a paid plan ends, the server returns to free and the one-online free limit is enforced again. Paid plans may unlock always-on capacity and higher resources as described on the Plans page.
• You are solely responsible for world content, plugins, mods, configurations, and player conduct on servers you own.
• Console access and file uploads (including plugin JARs) are powerful tools. Misuse that harms the platform, other customers, or third parties is prohibited.
• We may suspend, stop, migrate, or delete servers that violate these Terms, threaten infrastructure, or remain unpaid after notice where applicable.

4. Acceptable use

You agree not to use the Service to:

• Violate law, including hosting illegal content, malware distribution, or infringement of intellectual property.
• Attack, scan, or disrupt networks; mine cryptocurrency; send spam; or operate open proxies/botnets.
• Attempt to bypass plan limits, quotas, authentication, or billing.
• Interfere with other customers’ servers, the hub, agents, or proxy network.
• Upload or run software intended to escape container isolation or access HyHut infrastructure beyond your server data.

5. Billing

• Paid server plans and store purchases are processed by Stripe. By checking out, you authorize the charges shown at purchase.
• Subscriptions renew until canceled. Canceling a server plan typically reverts to the free tier at period end as described in the dashboard.
• Fees are generally non-refundable except where required by law or expressly offered by HyHut.
• We may change prices with notice for future billing periods. Continued use after the effective date constitutes acceptance.

6. Availability and data

We strive for reliable hosting but do not guarantee uninterrupted uptime, specific performance, or freedom from data loss. You should keep your own backups of important worlds. Maintenance, outages, DDoS events, upstream failures, or force majeure may affect availability.

7. Intellectual property

HyHut branding, site design, and platform software are owned by HyHut or its licensors. You retain rights to content you upload to your servers, and grant HyHut a limited license to host, back up, and transmit that content solely to operate the Service.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for Terms violations, abuse, non-payment, or risk to the platform. Upon termination, we may delete server data after a reasonable retention window unless law requires longer retention.

9. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYHUT AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO HYHUT FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM.

10. Indemnity

You will defend and indemnify HyHut against claims arising from your content, servers, plugins, players, or violation of these Terms or law.

11. Changes

We may update these Terms by posting a revised version with a new “Last updated” date. Material changes may also be communicated by email or site notice. Continued use after changes become effective means you accept the revised Terms.
